Terms of Service
Squawster is operated by RadioReference.com LLC (“Squawster,” “we,” “us”), the company behind Broadcastify, RadioReference, and Incident Source. The major public-safety incident information in Squawster is produced by Incident Source and is generated and classified by its Radiant Glow artificial-intelligence system. These Terms of Service (the “Terms”) are a legal agreement between you and RadioReference.com LLC governing your use of the Squawster mobile applications and this website (together, the “Service”). Please read them carefully. By downloading, installing, or using the Service, you agree to these Terms.
1. Acceptance of terms
By using the Service you accept these Terms and our Privacy Policy. The Service distributes audio and data from Broadcastify, RadioReference, and Incident Source, and your use of that underlying content is also governed by the Broadcastify and Incident Source terms. Where those terms conflict with these, the stricter restriction applies to the underlying content. If you do not agree, do not use the Service.
2. Description of the Service
Squawster provides access to publicly available radio scanner audio, feed archives, Broadcastify Calls, and major public-safety incident information, along with optional alerts and notifications. Features, content, and availability may change, be delayed, or be discontinued at any time without notice.
3. Eligibility and accounts
The Service is intended for a general audience and is not directed to children under 13. Some features require a Broadcastify or RadioReference account; you are responsible for your credentials and for all activity under your account. Provide accurate information and keep it current.
4. Squawster Pro subscriptions
Certain features (such as archive playback, cloud-synced favorites, custom Calls playlists, and ad-free listening) require Squawster Pro. You can unlock Pro two ways:
- An in-app subscription purchased through the Apple App Store or Google Play; or
- Signing in with an active Broadcastify Premium account, which is billed separately by Broadcastify and is not purchased through the app.
For the in-app subscription, the following terms apply:
- Squawster Pro is an auto-renewable subscription billed at the price shown in the app (currently $4.99 per month) on a monthly term.
- Payment is charged to your Apple App Store or Google Play account upon confirmation of purchase.
- The subscription automatically renews for the same term unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription, and turn off auto-renew, in your Apple App Store or Google Play account settings after purchase. Deleting the app does not cancel your subscription.
- Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.
- Prices may change; we will give notice as required, and price changes do not apply to the current paid period. Payments are non-refundable except where required by law or by the applicable app store’s policies, which govern refunds for in-app purchases.
Squawster is free to use and is supported by advertising. Users who are not Squawster Pro subscribers may see ads served by Google (Google AdMob within the apps and Google AdSense on this website), which are subject to Google’s terms and policies. Subscribing to Squawster Pro removes ads. We are not responsible for the content of third-party advertisements or for any website, product, or offer they link to; any interaction with an advertiser is solely between you and that advertiser. How advertising affects the data we and Google collect is described in our Privacy Policy.
5. Acceptable use
The Service is provided for your personal, lawful, non-commercial use. You may not, and may not permit others to:
- scrape, crawl, harvest, cache, or use automated or programmatic means to access the Service or its content except through interfaces we expressly provide;
- resell, sublicense, syndicate, rebroadcast, relay, re-stream, embed, or otherwise redistribute the audio, archives, alerts, or data, and any such use requires a separate commercial license from Broadcastify;
- use the Service or its content to train machine-learning or artificial-intelligence models without a written license;
- interfere with, disrupt, or place an unreasonable load on the Service, or attempt to bypass any security, rate-limiting, entitlement, or access control;
- reverse engineer, decompile, or extract credentials, keys, or tokens from the apps, or use them to obtain access you have not paid for; or
- use the Service for any unlawful purpose or in violation of the rights of others.
6. No reliance; not an emergency service
Audio, alerts, archives, and incident data are provided “as is” and “as available.” They may be wrong, incomplete, delayed, mislabeled, unavailable, or entirely absent, and are offered for informational and entertainment purposes only. Squawster is not an emergency service and must never be relied upon for emergency, safety-of-life, medical, or other critical decisions. Always call 911 or your local emergency number in an emergency.
7. Intellectual property
The Service, including its software, design, trademarks, and original content, is owned by RadioReference.com LLC and its licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the apps on devices you own or control, solely as permitted by these Terms and the applicable app store’s terms. All rights not expressly granted are reserved.
8. Disclaimers
To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or secure operation. We do not warrant that the Service will be error-free or continuously available.
9. Limitation of liability
To the fullest extent permitted by law, RadioReference.com LLC and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, or profits, arising out of or relating to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or US $1,000, except for liability that cannot be limited under applicable law.
10. Indemnification
You agree to indemnify and hold harmless RadioReference.com LLC and its affiliates from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the Service, your content, or your violation of these Terms or the rights of others.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 5–10 and 13) survive.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the effective date above and, where appropriate, by notice in the app or on this site. Your continued use after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas for any dispute not subject to arbitration or small-claims resolution, except where prohibited by applicable law.
14. Apple and Google
If you obtained the app from the Apple App Store or Google Play, your use is also subject to that store’s terms. Apple and Google are not parties to these Terms and are not responsible for the Service or its content; however, they are third-party beneficiaries of these Terms and may enforce them against you.
